1. Applicability
These consignment conditions apply to the legal relationship and all related legal and other acts between Corinphila and the Seller.
2. Auction mandate
In principle an auction mandate is confirmed when a consignment receipt is signed. The consignment receipt states, among other things, the insured and appraised value of the consignment.
An auction mandate is deemed to have been given in any case if an consignment has been submitted to the auctioneer.
The submission of material constitutes an irrevocable auction mandate.
3. Consignment process
Everyone is considered to have consigned their own material and cannot invoke a principal. Corinphila will sell the consignment as being genuine and accurately described at the Seller’s expense and risk. If subsequently a lot is found not to be genuine or is inaccurately described, the Seller is obliged to refund the full proceeds to Corinphila.
Corinphila may, without prior notice to the Seller, submit a consignment to a qualified expert for inspection to verify the condition of the consignment. The expertizing costs will be paid by the Seller.
Corinphila can divide a consignment into lots and describe it at its own discretion. If the Seller is of opinion that a description on the consignment confirmation is incorrect, the Seller must inform Corinphila of this in writing no later than two weeks after receiving the consignment confirmation.
Any consignment must be of good quality and the appraised value must be at least EUR 1,000.
4. Commission, limitation and unsold lots
In principle 20% commission will be charged over the final auction results as well as EUR 2 per lot (both including VAT). A different percentage can be agreed upon for larger entries in consultation.
A Seller can stipulate a reasonable limit, but if the lot remains unsold 50% of the starting price including VAT will be charged.
Consigned material can only be withdrawn in consultation with Corinphila. If the describing process has already taken place, costs amounting to at least the auction commission on the appraised value will be charged.
A Seller will receive a final detailed consignment lot list and auction catalogue approximately five weeks before the auction.
Settlement takes place in the agreed manner approximately six weeks after the auction.
By submitting material, the Seller indicates that it is aware of and accepts these terms and conditions in their entirety. It is only possible to deviate from them by written agreement.
In addition, the Seller also acknowledges that it is familiar with Corinphila’s Conditions of Sale as set forth in an auction catalogue.
5. Liability
Consignments will be handled with the utmost care. In addition, consignments are insured against fire, theft and water damage for the amount of the appraised value during transport and in Corinphila’s office.
Corinphila has adequate insurance to cover the risks that must be insured according to the usual industry standards.
Any liability of Corinphila is limited to the amount that Corinphila’s insurance pays out in a claim.
6. Privacy
The way we handle personal data provided by the Seller is provided in our privacy statement as published on our website.
7. Applicable law and competent court
If disputes arise, Dutch law will apply, and these will be settled by the Amsterdam District Court unless mandatory jurisdiction rules prevent this.
